This Agreement is between:
Subject to your compliance with these terms, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use FruitConnect on devices you own or control, in accordance with the tier you have purchased or activated.

The Pro tier is sold exclusively through Meta's In-App Purchase service. Billing, refunds, and subscription management for Pro are handled by Meta in accordance with Meta's terms. The Licensor does not collect Pro subscription payments directly.
Organization and Enterprise licenses are sold by the Licensor directly to businesses, schools, and other organizations for multi-seat deployment. Each license is bound to a named organization, and the FruitConnect application surfaces the organization name in its user interface alongside the tier ("🏢 Organization · Acme Corp"). License keys are issued in writing or via the Licensor's online sales channels and may be revoked if these terms are breached.
Organization and Enterprise licenses are bulk software licenses sold directly to a legal entity. They are not consumer purchases and are not subject to in-app purchase platform requirements.
Meta and its affiliates may grant Organizations the right to evaluate FruitConnect for a reasonable testing period free of charge through Meta Admin Center, in accordance with Meta's Developer Distribution Agreement Addendum. Evaluation does not entitle the organization to use Organization or Enterprise features without a paid Organization or Enterprise license.
Pro is a recurring subscription billed by Meta (monthly or annually). Cancellations and refund requests are processed by Meta. If your Pro subscription lapses, the application reverts to the Free tier on the next license validation.
Organization and Enterprise licenses are billed directly by the Licensor under terms specified in the purchase confirmation or master agreement. The Licensor may revoke a license key without refund if these terms are materially breached, including, without limitation:
Revocation takes effect at the next license validation round-trip and disables the affected device's access to paid features.
You agree that you will not, and will not permit any third party to:
FruitConnect, including all source code, binaries, designs, trademarks, and documentation, is owned by the Licensor and is licensed, not sold. All rights not expressly granted to you are reserved.
You retain all rights to the content you stream through FruitConnect; the application processes screen content locally on your Mac and transmits it peer-to-peer to your own Quest headset. The Licensor does not access, store, or transmit your screen content to any server.
Your use of FruitConnect is also governed by the FruitConnect Privacy Policy, available at:

The Privacy Policy explains what data the application stores locally, what is transmitted, and what is not collected. By using FruitConnect, you accept both this Agreement and the Privacy Policy.
FruitConnect uses third-party libraries, including but not limited to WebRTC, Meta Horizon Platform SDK, Jetpack Compose, Kotlin, AndroidX, CameraX, Google ML Kit, and Apple ScreenCaptureKit. These components are governed by their own licenses, which apply to those components and not to the proprietary FruitConnect code.

The Licensor may release updates, patches, and new versions of FruitConnect. Updates are governed by these terms unless accompanied by a separate license. Major changes to the license terms will be published at https://davidkaiser.dk/fruitconnect/eula.html with a revised "Last updated" date; continued use of the application after the effective date of a revision constitutes acceptance.
This Agreement applies until terminated. The Licensor may terminate this Agreement immediately if you materially breach these terms. You may terminate at any time by uninstalling FruitConnect. On termination, all license rights cease and you must stop using the application. Sections 4 (Acceptable use), 5 (Ownership), 10 (Disclaimer), 11 (Limitation of liability), and 13 (Governing law) survive termination.
FRUITCONNECT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE LICENSOR DOES NOT WARRANT THAT FRUITCONNECT WILL MEET YOUR REQUIREMENTS OR OPERATE WITHOUT INTERRUPTION ON ANY PARTICULAR HARDWARE OR NETWORK CONFIGURATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF FRUITCONNECT, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LICENSOR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO THE LICENSOR FOR THE FRUITCONNECT LICENSE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) 50 EUR.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. In those jurisdictions, the Licensor's liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless the Licensor from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of this Agreement, your unlawful use of FruitConnect, or your violation of any third-party rights.
This Agreement is governed by the laws of Denmark, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Denmark, except that the Licensor may bring proceedings in any jurisdiction where you reside or operate.
If you are a consumer resident in the European Union, mandatory consumer-protection laws of your country of residence may also apply.
